What is Food Poisoning?

upset stomach because of food poisoningEvery year in this country, there are approximately 5000 deaths related to food poisoning or foodborne illness. Despite restrictions and guidelines requiring restaurants to stay sanitary, people make mistakes all too often. There’s also the issue of pest infestations in restaurants.  Rats, cockroaches, and mice can carry disease making consumers sick. Workers forget or neglect to clean their stations or their hands or leave meat out way too long without refrigerating it.

You aren’t going to be able to see behind the scenes of every restaurant that you attend, so you might not know that negligence in the kitchen is exposing you to all sorts of foodborne illnesses and food poisoning. It’s estimated by the CDC that around 76 million people in this country are exposed to foodborne illnesses every single year and about 300,000 people end up in the hospital because of it.

If you were exposed to a foodborne illness or had food poisoning from visiting a restaurant, you should report it to the health inspector and then contact our Florida food poisoning lawyers as soon as possible.

Types of Foodborne Illnesses

You can catch the following types of foodborne illnesses at restaurants, gas stations, fast food joints, and more. If people are not careful and diligent with food prep, you can get seriously sick. Frequently seen types of foodborne illnesses include:

Botulism

Botulism is a foodborne illness which occurs because of lethal bacteria. Usually, if someone is sick of botulism, it was due to bacteria growth in canned goods. It could be vegetables or it could be meat.

Shigella

The illness caused by the germ shigella is called shigellosis. It is a disease of the intestines. If someone preparing the food is sick with shigellosis, you can fall ill. The main symptom is severe diarrhea.

Salmonella

You hear about the risks of salmonella all the time because it is so very dangerous and involves very common bacteria. The illness it causes can result in death. A lot of meat products can contain salmonella bacteria. That’s why you see a lot of recalls in the grocery stores. There are also a lot of cases of produce and dairy products getting contaminated.

Hepatitis A

There are five types of hepatitis viruses and hepatitis A is just one of them. It damages the liver and can be lethal. If you had already had liver issues to begin with, you’re even more at risk for serious illness and death. It can be spread through handling food or drinks from an infected person.

Listeria

Listeria is the bacteria that causes the illness listeriosis. What makes listeria so dangerous is that it can survive in very low temperatures which means it can stay alive in a refrigerator. It can also be passed from a pregnant mother to the child during birth. Listeria is why experts recommend cooking certain foods up to specific internal temperatures.

E.Coli

E. coli is typically found in food and water and is a bacterium. Most commonly you see E. coli in beef that has been undercooked, as well as sprout vegetables. You could suffer severe diarrhea from E. coli. It can be spread by an ill person handling food.

Symptoms of Food Poisoning

You may notice symptoms of exposure to a foodborne illness or food poisoning anywhere between a couple minutes after you start eating or even a couple weeks after you visited a restaurant. There are a lot of different illnesses that present differently but, generally speaking, if you suspect you were exposed and you are experiencing these symptoms you should seek medical treatment right away:

  • Headaches
  • Fever
  • Cramps
  • Nausea or vomiting
  • Diarrhea
  • Dehydration or exhaustion

A lot of people can get through being exposed to a foodborne illness and end up relatively fine afterwards but, for a lot of people, it can result in terrible conditions. If you have pre-existing conditions that weaken your immune system, you could get seriously ill.

How is a food poisoning case typically handled

How is a food poisoning case typically handled?

During an initial consultation recently with a client who was the victim of food poisoning, the client asked what the process was for handling those types of case in Florida. If you’re the victim of food poisoning, the first thing you want to do is hire a lawyer. Your lawyer will then contact the restaurant, if you haven’t already. They will get insurance information from the restaurant and work with the insurance company to resolve your claim. If the claim can’t be resolved pre-suit, your attorney will then file a lawsuit and, if necessary, take your case to trial. If you have any questions or concerns about your food poisoning case and what you can expect going forward if you do have a case, please give us a call.

What are some practical concerns about filing a food poisoning lawsuit?

We recently received a great question from a potential client the other day who was wondering what kind of compensation they can expect if they were the victim of food poisoning. It depends on the nature of every situation. Luckily, most food poisoning cases are mild, in which case the compensation that you might receive is minimal. In rare cases, you can be severely injured as a result of food poisoning. If you have a large amount of past medical bills and you’re going to need continuing care going forward, what the pain and suffering in the past and the future would look like all depends on the nature of your food poisoning. If you are experiencing food poisoning, you should immediately document your symptoms, get medical treatment if necessary, call the restaurant and let them know that you were sick so that they can take the food off of their menu or their shelves so that other people don’t get sick, and then call a lawyer who is experienced in food poisoning lawsuits.
